At the Romanian Government meeting on September 24, 2020, was amended the Government Decision no. 626/2001 for the approval of the Methodological Norms for the application of Law no. 268/2001 regarding the privatization of commercial companies that own land owned by the public and private property of the State with agricultural use and the establishment of the State Domain Agency (ADS).

The adoption of this normative act creates the legislative framework necessary to complete the Young Farmers Installation Program, through the granting of facilities, concession / lease, respectively, of agricultural land with an area of ​​up to 50 ha, in order to settle in rural areas and carry out agricultural activities.

The objective of this normative act is to modify, complement and regulate the Methodological Norms for the application of Law No. 268/2001, which provide for the possibility that ADS leases / leases agricultural land, free of contract in the maximum area of ​​50 ha, belonging to the public or private domain of the State, by direct award, to young people up to 40 years old, graduates for the formation of agricultural profiles, in order to set up farms.

This sentence considers the following:

• it modifies the provisions regarding the compensation of debts that represent royalties owed and not paid on time by the land concessionaires;
  
  
• establishes the categories of beneficiaries, the eligibility conditions and the documents that prove their fulfillment, as well as the obligation to establish a form of organization in accordance with the applicable legislation;
  
  
• establishes the obligation of applicants to set up a farm, as defined in Law No. 37/2015 on the classification of farms and agricultural holdings, with subsequent modifications, within a period of 1 year from the date of signing the contract, in which you will have the status of farm manager;
  
  
• regulates the procedure for the conclusion of concession and lease contracts, by direct award or by competitive procedure;
  
  
• the way to verify compliance with the conditions for the installation of a farm and constitute a form of organization, as well as the establishment of the penalty for non-compliance with these conditions, as well as the legal termination of the concession or lease contracts, respectively .
